AN ACT TO REGULATE THE BUSINESS OF' INSURANCE IN THE STATE, STOP THE OPPRESSION OF THE TRUST AND TO SECURE THE PAYMENT OF ALL LOSSES WITHOUT DELAY OR LAW SUITS.
Be it enacted, &c.:
Sec. I. The office of Commissioner of Insurance be, and the same is, hereby created, and at the next general election said officer shall be chosen by the qualified voters of the state to serve for a term of one year, and shall be regularly elected every year thereafter; Provided, that for the purposes of securing impartiality no person shall be a candidate for or qualified to hold such office who has ever been employed by, or had any connection with, any fire, life, marine, accident or miscellaneous insurance company or association whatever; and, further, that no vote shall be cast for such officer at any election by any persons employed by or connected with any insurance companies suspected of being members of the insurance trust. Only such per-sons shall vote as shall hold policies of insurance which may at some time become claims.
Sec. 2. After his election it shall be the duty of said Commissio Fer of Insurance to take such steps as he may think necessary to impartially protect the people of this state against the oppressions and insidious and damning encroachments of the insurance trust, and for that purpose he is hereby granted full plenary powers to fine, restrain or entirely throw out of the state any company that shall fail or refuse to obey the instructions which the Commissioner of Insurance may promulgate; and he may, from time to time, change or alter these instructions if he consider a change neces-
